stop and cull 911 for help. the woman is believed to be 19 years old and was taken to regional medical center where she died about an hour later. police cannot say whether the shooting was gang-related or what the other motive might have been, but the driver who was with the woman was not considered a suspect and his identity is not being released yet. this is san jose's 30th homicide of the year. still no deal. bart and union leaders ended talks without a contract agreement. that would avert a strike. the two sides are expected to return to the bargaining table at 10:00 this morning. the bart general manager said there is progress and several

none are yet in place and the travel alert is in effect through august 31st. >> life in prison is the sentence for the man who shot and killed coworkers at a tech firm five years ago. a santa clara county judge sentenced killer woo yesterday who murdered three coworkers at sea port, a small tech firm in november of 2008 after being fired from his job. he claimed he was stark raving mad when he gunned down victims, but a jury cited revenge and first-degree murder. the victims did not hold back their feelings in court in woo's sentencing. >> cold and calculating and selfish and careless, evil individual. he has shown no remorse for what he has done. he should never be allowed out because he has no regard for human life. >> woo's attorney said there will be an appeal. the prosecution said they are

confident that appeal will be rejected. >> the city of richmond made good on a promise to sue chevron. they earned $241 billion a year and richmond wants some of that cash to pay for the city's response to the emergency and aftermath of last year's refinery fire. the city filed a 39-page complaint saying it was not an accident, but disregard for public safety. chevron knew about the condition of their pipe and did nothing to prevent failure. >> the purpose of this lawsuit has never been about money. the purpose is changing culture. >> we want to seat highest standards of safety put forward. >> they called the lawsuit meritless. the baseless allegations are

discovery of faulty bolts on the new span. they said the tests will not further delay the bridge that has been pushed to at least december and not labor day. >> a california connection to the tainted salad and the bad lettuce is linked to taylor farms of salinas. they produced the salad mix and at least 400 cases of infection have been reported in 16 states as of yesterday. they will conduct an assessment of the mexican processing facility to learn the cause of the outbreak. >> you might want to keep your bicycle inside your home when you are not using it, especially if you live in menlo park. the city has seen an increase in bike thefts and so far 53 have been swiped this year alone. police believe there hundreds more that have not come to their

>> good morning to you. looking live from our city camera at the san mateo bridge and boy, it looks like winter and not like the first week of august. rob has a look at the forecast that might make you take out a sweater. >> the temperatures are in the 50s and we get a taste of the san francisco summer weather all the way inland this morning with the low clouds towards the trivalley. 55 in san jose. 54 in san francisco. 55 in fairfield. the winds really telling the story. you have a south breeze into the north bay and pushing in low clouds and fairfield is strong there. southwest at 21. a southeast wind through the

salinas valley with the low clouds in and around gilroy and san jose. cool temperatures at the ballpark. a's taking on the rangers and temperatures in the mid 60s through the game. this is fantastic for the festival of the arts. temperatures in the mid 70s. go out there and enjoy it. it should be wonderful weather-wise. great food and great times to be had out there. low clouds starting off with mist in spots, especially out towards the coast with an all day sea breeze. this is why the temperatures are mild. normally you see 90s inland. not going to get it this weekend and more cooling as it turns a bit stronger early next week. satellite and radar shows you for the sierra, things have calmed down. the monsoon moisture that fired up thunderstorms pushed off to the east and the upper level low is spinning which may try to throw high clouds our way. other than that, that will help to reinforce the wind pattern

that will bring the low clouds in and break up the sunshine by midday for the valleys. look at san francisco and the coast. from 12:00 through the afternoon looks like a mostly cloudy and cool if not misty day. san francisco only close to 60 for a high and low 60s near the coast for the weekend. 70s and low 80s and if you have evening plans as early as 9:00, the low clouds already spilling back in after sundown later this evening. temperatures in the 70s to near 80. mid 80s to the south and that should be the warmer temperatures around pleasant and the trivalley. 70 frz castro valley and hayward and now we are in the 60s. san francisco is quite cool with the low clouds. 70s around the north bay. a mild weekend as we go through the forecast. they are reminding you that it's football season. we have cowboys and the dolphins

nearly three months ago the world watched in horror when a

garment factory collapsed in bangladesh, killing more than 1100 workers. dozens of worldwide retailers signed a plan to conduct independent factory inspections, but absent from the list, bay area clothing giants gap and levi straus. diane dwyer looks at why and how consumers can buy conscious clothing. >> the images of trapped young workers forced people to take a close look at how and where their clothes are made. >> it's terrible that it takes a tragedy like this to really be a wake up call. >> heather has spent her career to improve the lives of third world workers and farmers. as the director of good world solutions, she is empowering workers through cell phones which surprisingly many of them have. >> workers in bangladesh saw cracks in the walls and because they weren't able to report that to decision makers, over 1,000

workers died. with the power of mobile technology now and we are approaching a one to one ratio between workers and mobile subscriptions, they have their own phones, that allows us to communicate in a new way. >> she is doing what she can, but would like to see retail companies show more leadership to bring about change. >> larger companies have leverage with factories to push for change. if we are going to see large scale change, it has to be from larger companies stepping up and making the commitments. pafr ever two major retailers are head quartered in san francisco. the gap here and across town levi straus. they chose not to join the mostly european retailers's plan to inspect the factories in the next nine months and refused our request for on camera introduce. an e-mailed statement said "our

supply chain policies are so strict that we only use 13 factories in bangladesh out of the more than 4,000 in the country. we built an industry-leading 20-year safety record in bangladesh and have not had production in any of the facilities where the tragedies occurred." they formed an alliance with wal-mart, jc penny and nordstrom. in an e-mail statement, a gap spokes woman said it brings together retailers and industry associations from across north america to play a substantial role in improving working conditions for the people in bangladesh's garment industry. labor groups claim this plan which would create a 42 million dollar fund does not nearly go far enough and pay towards the renovation and repair of bangladesh factories. >> these come in different colors. >> some smaller companies make conscious clothing part of the overall mission. prada is based out of l.a. and

hour by hour, sunshine inland and fog and low clouds hanging out all day and by 7:00 it's heading back to oakland. highs today with san francisco and oakland looking at 60s and upper 70s and mid 80s. low 60s inland today near the trivalley. they seem mild i'm sure and even cooler ahead. we will have the forecast in a few minutes. >> breaking news in downtown san jose. a woman was shot while a passenger in a car driving near south third and east san salvador streets. it was about 1:00 this morning when the woman and a 21-year-old man r7 drivi was driving. the driver who was not hit stopped to call 911 for help. the woman is believed to be 19 and taken to regional medical center where she died less than

crime that took three lives, the families say they finally have justice this morning. the man convicted of killing his coworkers at a south bay tech company will spend the rest of his life behind bars. today in the bay has a decision that brings closure to a story that shook up the community in 2008. >> you are the biggest fool because you destroyed your own family and own with your petty feelings and acts of revenge. >> the families did not hold back, letting the convicted killer know how they felt about him. >> mr. woo is a calculating, selfish, careless, evil individual who has shown no remorse for what he has done. he should never be allowed out and he has no regard for human life. >> woo will spend the rest of his in prison for murdering three coworkers at a small tech firm in 2008.

as it approached a check point. nine civilians died and most of them were children. gunfire could be heard in the area after the explosion and the roads there were blocked. the attack comes as the united states planned to close a number of embassies and consulates response to the threat. no group has claimed responsibility. standing their ground this morning, supporters of egyptian president morsi are defying demands for them to leave their sit ins. the government is threatening to force the sit ins to clear out. morsi supporters say they will not disburse until he returned to power. so far there no signs of concrete measures from either side to find consensus in this political crisis. the city of richmond made good on the promise to sue chevron. the san ramon-based chevron

that amounts to 8 percent per of all state prisoners. a lower court ordered them released and the supreme court upheld that decision. the concern is that our prisons are overcrowded and pose a health risk to inmates. governor brown said that releasing that many criminals by the end of the year jeopardizes public safety. the state is working on back up plans including back up contracts to house the inmates. it just needs funding by the state legislature. still ahead, groceries and a lot more coming to san jose. find out what will separate a new whole foods store and other stores. look at 'em.

warnings ignored. new information about the deadly train crash in spain last week. investigators say the driver received three warnings to slow down in the two minutes before this crash when the train flew off the tracks, killing 79 people. a court statement said the driver was talking on the phone when he received the first warning. the last warning came just 250 yards before a dangerous curve where the train derailed. at that point the train was going 121 miles per hour in what was a 50 mile per hour zone. >> not just high end groceries and organic goods, but a high end beer garden. whole foods is expanding as a new location will be refreshing for many people. it will be a groundbreaking for the new store on august 21st. we hear it will feature a 5,000 square foot brewery that will fit by the shark tank. whole foods is opening in fremont, walnut creek and

>> good morning in san jose. the low clouds have made their way into the santa clara valley. a cool start and cloudy skies, but a sunny finish in the forecast. not so much for san francisco and the coast for the low clouds stick around this weekend. you can see we have a mild start to the morning and mostly 50s outside. a healthy sea breeze getting into fairfield and parts of the east bay into contra costa and solano counties. into the north bay it will make for a cool day at the ballpark.

we sue how a bay area doctor wants to change how the word is used when doctors talk with patients and even each other. >> anyone who ever waited through the world of inside has tripped over the confusing terminology over medical jargon. still one word that is universally understood. >> most people when they hear the word cancer assume they are going to die without aggressive treatment. >> ucsf cancer surgeon knows that is certainly not always the case. >> the understanding of cancer is that it encompasses many, many more diseases and may never bogger you and some are very aggressive. >> one example are small lesions found in the milk grands of some women, they are not 23409 cancerous even though they bear the name ductal carcinoma. >> some should not be called cancer. we should get the word out of

the name so that we don't frighten people. >> a panel of researchers are calling on leaders to change the terminology sounding cancer so that lesser continues that may not develop into the disease no longer bear the ominous names. the group's findings were published in the journal of the american medical association. they said terminology is just the first step. she thinks doctors should ease aggressive treatment on slow-growing precancerous conditions so they can be studied. >> let's have registries and follow it and learn where treatments make a difference and where they don't. >> medical experts express concern saying doctors shouldn't sugar coat patient conditions when they don't actually know whether or not they'll turn cancerous. he said increases in health screenings are turning up things that may not require sounding the alarm and removing the c word may help keep the word fear

>> and looking live at o.cocoliseum where the a's take on the texas rangers at 1:05. the rangers will hope for the texas heat. they won't get it today though. the green and gold took on the second place rangers in game one of the series last night. they got off to a good start when brandon moss doubled in lowrie and took a 2-0 lead in the first inning. it was all texas after that. the rangers scoring the next six runs on the way to an 8-3 win. the giants in tampa bay to take on the rays. madison baumgartner was dominant

on the round. he pitched seven pgs and 11 strike outs. brandon broke a 1-1 tie and the giants go on to win their third straight game, beating the rays, 4-1. from the big leaguers to the little leaguers and it was a close one. not enough to get the win for the pleasanton nashls yesterday. they played in the world series in livermore this week. the boys from pleasanton knocked off the teams and lost 6-5 in the game that was heavily favored from houston. the team plays again this afternoon at the same location. if they win they will advance and play the team again, but this time for all the marbles. still ahead on today in the bay, we have lyndon who is looking for his forever home. precious little monkey. it is a dog though. we will talk about him coming

>> our friends from pets in need are here this morning. volunteer lisa simmons is here with lyndon, a very regal name for a very little dog. tell us about lynndie. >> lynndie actually is a 3-month-old puppy from a litter of five. we have the rest of his siblings at the shelter. they are all looking for homes. they were out in foster and have been exposed to children and cats and other dogs and vacuum cleaners and everything else you can imagine. >> i love how you torture them and call it socialization. >> he is acting a little shy right now but he's not really. they are rate to go. microchipped and fixed. then we just make fabulous additions to any family. >> it doesn't appear that he will be too big. >> he's not.
